Diversion of prescribed controlled substances and the resulting addiction and crime have become an epidemic in the United States over the past 5-7 years. The United States Drug Enforcement Administration (DEA) is requiring all manufacturers, distributors and dispensers of controlled substances to assume much greater responsibility for establishing and implementing specific procedures that ensure items such as Oxycodone, Hydrocodone, Alprazolam, Tramadol and other controlled prescription products are not being diverted for illicit use.
Manufacturers and distributors are required to "know their customers" and maintain suspicious order monitoring systems that identify orders of controlled substances that are outside of "normal" orders. However, neither the Federal Controlled Substances Act (the "Act") nor the DEA has provided any specific guidelines regarding the manner in which these requirements are to be carried out in the course of the business conducted by manufacturers and distributors. Pharmacists have a corresponding responsibility along with physicians to ensure that controlled substance medications are only dispensed to patients based on prescriptions written for legitimate medical purposes and in the normal course of professional practice pursuant to the provisions of the DEA Pharmacist's Manual, page 30. This responsibility is not limited to determining that the prescribing physician has a valid DEA license and has fulfilled the requirements of a written prescription.
Each of the aforementioned entities must develop the processes that it feels are both necessary and appropriate to meet the requirements that the DEA has mandated. In the case of Anda, controlled substances are sold only to pharmacies, not physician practices or clinics. Any pharmacy customer that has not purchased controlled substances from Anda within the last six (6) months is not eligible to purchase control substances from Anda.
